Introduction
Katalogue KDMS ("we," "our," or "us") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our service.

Filing a DMCA Takedown Notice
If you believe that content available on Katalogue infringes your copyright, you may submit a DMCA takedown notice. To be valid, your notice must include:
- A physical or electronic signature of the copyright owner or authorized agent
- Identification of the copyrighted work(s) claimed to have been infringed
- Identification of the material that is claimed to be infringing, with enough detail to locate it (URLs, titles, usernames)
- Your contact information (address, telephone number, and email address)
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on their behalf
Warning: Under Section 512(f) of the DMCA, anyone who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.
How We Process Takedown Notices
Upon receiving a valid DMCA takedown notice:
- We will remove or disable access to the allegedly infringing content, typically within 24-48 hours
- We will notify the user who uploaded the content that it has been removed
- The affected content will not generate royalties during the dispute period
- We will provide the uploader with a copy of the takedown notice
Filing a Counter-Notice
If you believe your content was removed by mistake or misidentification, you may file a counter-notice. Your counter-notice must include:
- Your physical or electronic signature
- Identification of the material that was removed and its location before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
- Your name, address, and telephone number
- A statement consenting to jurisdiction of the federal court in your district (or if outside the US, any judicial district where Katalogue may be found)
- A statement that you will accept service of process from the original complainant
Counter-notices must be submitted within 10 business days of receiving the takedown notification.
Counter-Notice Process
Upon receiving a valid counter-notice:
- We will forward the counter-notice to the original complainant
- We will inform them that we will restore the removed content in 10-14 business days
- If the complainant does not file a court action within that time, the content may be restored
- If the complainant files a lawsuit, the content will remain disabled pending court resolution
Repeat Infringer Policy
Katalogue maintains a strict repeat infringer policy in accordance with DMCA requirements:
First Violation
Warning issued, infringing content removed
Second Violation
30-day account suspension, all content reviewed
Third Violation
Permanent account termination, forfeiture of pending earnings
Terminated accounts cannot be reinstated. We may also report repeat infringers to industry anti-piracy organizations.
False Claims
We take false DMCA claims seriously. Filing a fraudulent takedown notice may result in:
- Liability for damages under Section 512(f) of the DMCA
- Responsibility for attorneys' fees and court costs
- Potential criminal perjury charges
- Permanent ban from filing notices with Katalogue
Protecting Your Content
If you're a creator on Katalogue, we recommend:
- Keep records of your original work (project files, recording sessions, timestamps)
- Register your copyrights with the U.S. Copyright Office for enhanced legal protection
- Use metadata and watermarks where appropriate
- Document your creative process with dated backups
